If the house I was buying didnt appraise high enough should the seller pay me back for the $400 fee?

Im getting back my $500 earnest money. But he had it appraised when the house wasnt even finished. The appraiser even said before she came out the gas needs to be cut on, stove needs to be installed, walls painted, & so on
